Viewmax LLC ("Viewmax," "we," "us," or "our") provides an AI-powered video creation and editing platform. This Privacy Policy describes how Viewmax processes personal information that we collect through our digital or online properties or services that link to this Privacy Policy (including our website and application) as well as our marketing activities and other activities described in this Privacy Policy (collectively, the "Service").

Notice to European users: please see the Notice to European users section below for additional information for individuals located in the European Economic Area or United Kingdom (which we refer to as "Europe," and "European" should be understood accordingly).

1. Personal Information We Collect

Information you provide to us includes:

• Contact data, such as your name and email address.
• Profile data, such as the username and password you may set to establish an account, your profile picture, and preferences you save in the Service.
• Communications data based on our exchanges with you, including when you contact us for support, through social media, or otherwise.
• Transactional data, such as information relating to your purchases of subscriptions or credits, including transaction history.
• User-generated content and input data, such as videos, audio, images, scripts, prompts, and other content or information that you upload, generate, or otherwise make available on the Service, together with associated metadata.
• Marketing data, such as your preferences for receiving our marketing communications and details about your engagement with them.
• Payment data needed to complete transactions. Payment card information is collected and processed directly by our payment processors (see "How we share your personal information" below); we do not store full card numbers.
• Other data not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.

Third-party sources. We may combine personal information we receive from you with personal information we obtain from other sources, such as third-party login services (for example, if you sign in with Google, we receive your name, email address, and profile picture as permitted by your settings on that service), public sources, and service providers that help us operate the Service.

Automatic data collection. We, our service providers, and our business partners may automatically log information about you, your computer or mobile device, and your interaction over time with the Service and our communications, such as:

• Device data, such as your operating system type and version, browser type, screen resolution, device type, IP address, unique identifiers, language settings, and general location information such as city, state, or geographic area.
• Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, the website you visited before browsing to the Service, navigation paths between pages, access times, and duration of access.
• Communication interaction data, such as your interactions with our emails (for example, whether you open them or click links within them), which we may collect through pixel tags.

2. Tracking and Other Technologies

Cookies and similar technologies. Some of our automatic data collection is facilitated by cookies and similar technologies. For more information, see our Cookie Policy. We also store a record of your preferences in respect of the use of these technologies.

AI technologies. The Service uses generative AI technologies provided by third parties — including OpenAI, Anthropic, Google, Groq, ElevenLabs, Kling, and BytePlus — to power features such as script generation, voiceover, and image and video generation. When you use these features, your prompts and the content you provide as input may be transmitted to the applicable provider to generate the requested output. We require these providers to maintain appropriate data protection safeguards.

3. How We Use Your Personal Information

We may use your personal information for the following purposes or as otherwise described at the time of collection:

• Service delivery and operations — to provide the Service; process your video, audio, and image generation requests; enable security features; establish and maintain your account; process transactions; communicate with you about the Service (including announcements, updates, security alerts, and support messages); and respond to your requests, questions, and feedback.
• Service personalization — to understand your needs and interests, personalize your experience, and remember your selections and preferences.
• Service improvement and analytics — to analyze usage of the Service, improve the Service and our business, and develop new products and services. We use Mixpanel and Google Analytics for this purpose; see our Cookie Policy for more information.
• Marketing and advertising — we may send you direct marketing communications, which you can opt out of as described below. We and our advertising partners may also use cookies and similar technologies for interest-based advertising, including the Meta (Facebook) Pixel and Meta Conversions API, which may receive your hashed email address, IP address, device and browser information, and events such as signing up or purchasing a subscription. • Compliance and protection — to comply with applicable laws, lawful requests, and legal process; protect our, your, or others' rights, privacy, safety, or property (including by making and defending legal claims); audit our compliance; enforce the terms and conditions that govern the Service; and prevent, identify, investigate, and deter fraudulent, harmful, unauthorized, unethical, or illegal activity.
• Aggregated, de-identified, or anonymized data — we may create aggregated, de-identified, and/or anonymized data from personal information by removing information that makes the data identifiable to you, and we may use and share such data for our lawful business purposes, including analyzing and improving the Service.

4. Retention

We generally retain personal information to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements, establishing or defending legal claims, or for fraud prevention purposes. To determine the appropriate retention period, we may consider factors such as the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process it, and applicable legal requirements. When we no longer require the personal information we have collected about you, we may delete it, anonymize it, or isolate it from further processing.

5. How We Share Your Personal Information

We may share your personal information with the following parties, or as otherwise described in this Privacy Policy or at the time of collection:

• Service providers — third parties that provide services on our behalf or help us operate the Service (such as hosting, cloud storage, AI model providers listed above, email delivery, customer support, and analytics).
• Payment processors — payment card information you use to make a purchase is collected and processed directly by our payment processors, such as Stripe. Stripe may use your payment data in accordance with its privacy policy at stripe.com/privacy.
• Advertising partners — third-party advertising companies (such as Meta) for the ad-measurement and interest-based advertising purposes described above. Under some U.S. state privacy laws this is considered "sharing" for cross-context behavioral advertising; you can opt out on our Your Privacy Choices page.
• Third parties designated by you — where you have instructed us or provided your consent to share your information.
• Linked third-party services — if you log into the Service with, or otherwise link your account to, a third-party service, we may share information with that service as governed by its privacy policy and your settings.
• Professional advisors — such as lawyers, auditors, bankers, and insurers, in the course of the professional services they render to us.
• Authorities and others — law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the compliance and protection purposes described above.
• Business transferees — we may disclose personal information in the context of actual or prospective business transactions (such as investments in or financing of Viewmax, or the sale, transfer, or merger of all or part of our business or assets), and to an acquirer, successor, or assignee as part of any such transaction or in the event of an insolvency, bankruptcy, or receivership.

Content you choose to share. If you choose to publish, share, or export content you create with the Service, that content can be seen, collected, and used by others, and we are not responsible for any such use.

6. Your Choices

• Access or update your information. If you have registered for an account, you may review and update certain account information by logging into the account.
• Opt out of marketing communications. You may opt out of marketing-related emails by following the unsubscribe link in the email, from your email settings, or by contacting us. You may continue to receive service-related and other non-marketing emails, such as receipts, payment notices and account security messages.
• Cookies and advertising. For information about cookies and how to control them, see our Cookie Policy. To opt out of the sharing of your information for advertising, visit Your Privacy Choices. We also honor the Global Privacy Control ("GPC") browser signal as a valid opt-out request.
• Declining to provide information. We need to collect personal information to provide certain services. If you do not provide required information, we may not be able to provide those services.
• Delete your content or close your account. You can delete projects and content through your account, and you can request account deletion at any time in your account settings or by contacting support@viewmax.io.

7. Other Sites and Services

The Service may contain links to websites and other online services operated by third parties, and our content may be integrated into online services that are not associated with us. These links and integrations are not an endorsement of, or representation that we are affiliated with, any third party. We do not control third-party websites or services and are not responsible for their actions. We encourage you to read the privacy policies of the other websites and services you use.

8. Security

We employ technical, organizational, and physical safeguards designed to protect the personal information we collect. However, security risk is inherent in all internet and information technologies and we cannot guarantee the security of your personal information.

9. International Data Transfer

We are headquartered in the United States and may use service providers that operate in other countries. Your personal information may be transferred to the United States or other locations where privacy laws may not be as protective as those in your state, province, or country. Users in Europe should read the important information about transfers of personal information outside of Europe in the Notice to European users section below.

10. Children

The Service is not intended for use by children under 13 years of age. If you are a parent or guardian of a child from whom you believe we have collected personal information in a manner prohibited by law, please contact us. If we learn that we have collected personal information through the Service from a child without the consent of the child's parent or guardian as required by law, we will comply with applicable legal requirements to delete the information.

11. Changes to This Privacy Policy

We reserve the right to modify this Privacy Policy at any time. If we make material changes, we will notify you by updating the date of this Privacy Policy and posting it on the Service or by other appropriate means. Any modifications will be effective upon our posting the modified version (or as otherwise indicated at the time of posting). Your use of the Service after the effective date of any modified Privacy Policy indicates your acknowledgment that the modified Privacy Policy applies to your interactions with the Service and our business.

13. State Privacy Rights Notice

Except as otherwise provided, this section applies to residents of U.S. states to the extent they have privacy laws applicable to us that grant their residents the rights described below (collectively, the "State Privacy Laws"). Not all rights listed below may be afforded to all users, and we may decline your request in certain cases as permitted by law. We may not be able to process your request if you do not provide us with sufficient detail to allow us to confirm your identity or understand and respond to it.

The State Privacy Laws may provide you with some or all of the following rights:

• Information. You can request information about how we have collected and used your personal information, including the categories of personal information collected, the sources, the purposes, and the categories of third parties with which we share it.
• Access. You can request a copy of the personal information we have collected about you.
• Correction. You can ask us to correct inaccurate personal information.
• Deletion. You can ask us to delete the personal information we have collected from you.
• Appeal. You can appeal our denial of any request validly submitted.
• Opt-out of targeted advertising. We may process personal information for targeted advertising purposes as described above. You can opt out on our Your Privacy Choices page.
• Profiling and automated decision-making. We do not use your personal information to engage in profiling or automated decision-making that produces legal or similarly significant effects.
• Sales of personal data. We do not sell your personal information for money.
• Sensitive personal information. We do not intentionally collect or process sensitive personal information for the purpose of inferring characteristics about you.
• Consumers under 16. We do not have actual knowledge that we collect, sell, or share the personal information of consumers under 16 years of age.
• Nondiscrimination. You are entitled to exercise the rights described above free from discrimination as prohibited by the State Privacy Laws.

Exercising your right to opt out of the "sale" or "sharing" of your personal information. While we do not sell personal information for money, we use services that help deliver interest-based ads to you as described above, and the State Privacy Laws may classify our use of some of these services as "selling" or "sharing" your personal information. You can submit requests to opt out on our Your Privacy Choices page, via email to support@viewmax.io, or by broadcasting the Global Privacy Control ("GPC") signal. We honor GPC signals as valid opt-out requests for the sale or sharing of personal information, as required by applicable law. For more information about GPC, visit globalprivacycontrol.org.

Exercising other state privacy rights. You may submit requests to exercise any of the other state privacy rights listed above via email to support@viewmax.io.

Verification of identity; authorized agents. We may need to verify your identity in order to process your requests and reserve the right to confirm your residency. Under some State Privacy Laws, you may enable an authorized agent to make a request on your behalf; we may need to verify your authorized agent's identity and authority to act on your behalf.

California Shine the Light. Under California Civil Code Section 1798.83, California residents may ask companies with whom they have formed a business relationship primarily for personal, family, or household purposes for the names of third parties to which they have disclosed certain personal information during the preceding calendar year for those third parties' own direct marketing purposes. You may send us requests for this information to support@viewmax.io with the statement "Shine the Light Request," your first and last name, and certification that you are a California resident.

Nevada residents. Nevada residents have the right to opt out of the sale of certain personal information for monetary consideration. While we do not currently engage in such sales, if you are a Nevada resident and would like to make a request to opt out of any potential future sales, please email support@viewmax.io.

14. Notice to European Users

The information in this section applies only to individuals in the United Kingdom and the European Economic Area. References to "personal information" in this Privacy Policy should be understood to include a reference to "personal data" as defined in the GDPR and UK GDPR (together, the "GDPR").

Controller. Viewmax LLC is the controller in respect of the processing of your personal information covered by this Privacy Policy for purposes of European data protection legislation. See the How to contact us section above for our contact details.

Legal bases for processing. The GDPR requires us to have a legal basis for each use of your personal information. We rely on: contractual necessity for service delivery and operations (including processing your content to generate the output you request and processing your transactions); legitimate interests for security, service improvement and analytics, direct marketing, and compliance and protection purposes, where your interests and fundamental rights do not override those interests; compliance with law where we need to comply with a legal or regulatory obligation; and consent for optional cookies and interest-based advertising, and in other circumstances where consent is required under applicable law. Where we rely on consent, you have the right to withdraw it at any time.

Retention. We retain personal information as described in the Retention section above. When we no longer require it, we will delete or anonymize it or, if this is not possible (for example, because it is stored in backup archives), securely store it and isolate it from further processing until deletion is possible.

No sensitive personal information. We ask that you not provide us with any sensitive personal information (e.g., information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background, or trade union membership) on or through the Service. If you provide us with any sensitive personal information when you use the Service, you consent to our processing of it in accordance with this Privacy Policy.

No automated decision-making or profiling. As part of the Service, we do not engage in automated decision-making and/or profiling that produces legal or similarly significant effects.

Your rights. European data protection laws give you certain rights regarding your personal information. If you are located in Europe, you may ask us to: access your personal information; correct inaccuracies; delete your personal information; transfer a machine-readable copy to you or a third party of your choice; restrict processing; object to processing based on legitimate interests or for direct marketing purposes; and withdraw consent where processing is based on consent. You may submit these requests by email to support@viewmax.io. We may request specific information from you to help us confirm your identity and process your request. If we reject a request, we will let you know our grounds for doing so, subject to legal restrictions.

Complaints. If you are not satisfied with our response to a request, or with how we process your personal information, you can lodge a complaint with the data protection regulator in your habitual place of residence. For users in the UK, that is the Information Commissioner's Office (ico.org.uk, Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF, Tel. +44 303 123 1113).

Data processing outside Europe. We are a U.S.-based company and many of our service providers and other recipients of data are also based in the U.S., which is not the subject of a general "adequacy decision" under the GDPR. Where we share your personal information with third parties based outside Europe, we try to ensure a similar degree of protection by transferring to territories with an adequacy decision, using appropriate safeguards such as standard contractual clauses approved by relevant authorities, or, in limited circumstances, relying on a derogation such as your explicit consent.
