Copyright and DMCA
How to report content you believe infringes your copyright, and how to respond to a report.
Where to send a notice
Send copyright notices to our designated agent under the Digital Millennium Copyright Act (17 U.S.C. § 512).
Copyright agentViewmax LLC, doing business as Everygensupport@viewmax.ioYou can also use our report form and choose "Copyright". A report through the form reaches the same team, but it only counts as a DMCA notice if it includes everything listed below.
What a notice must include
Under 17 U.S.C. § 512(c)(3), your notice must include:
- A physical or electronic signature of the copyright owner or a person authorized to act for them.
- Identification of the copyrighted work you believe is infringed, or a representative list if there are several.
- Identification of the material you believe is infringing, with enough detail for us to find it. A share link (an everygen.ai/share address) is the fastest way.
- Your name, postal address, telephone number and email address.
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.
Under 17 U.S.C. § 512(f), anyone who knowingly misrepresents that material is infringing may be liable for damages. If you are not sure the use is infringing, talk to a lawyer before you send a notice.
What happens next
When we receive a complete notice, we disable public access to the material and keep a record of the notice. The user's own copy stays in their account.
Counter-notices
If your content was disabled and you believe that was a mistake or a misidentification, you can send a counter-notice to the agent above. Under 17 U.S.C. § 512(g)(3), it must include:
- Your physical or electronic signature.
- Identification of the material that was disabled and where it appeared before it was disabled.
- A statement under penalty of perjury that you have a good faith belief the material was disabled as a result of mistake or misidentification.
- Your name, postal address and telephone number.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or, if your address is outside the United States, any judicial district in which Everygen may be found), and that you will accept service of process from the person who sent the original notice or their agent.
We send a copy of a valid counter-notice to the person who sent the original notice. If they do not tell us within 10 business days that they have filed a court action, we may restore the material 10 to 14 business days after we received the counter-notice.
Repeat infringers
We keep a record of the notices each account receives. In appropriate circumstances we terminate the accounts of users who repeatedly infringe copyrights.
