Biometric Data Policy

What face and voice data we collect, why, who receives it, and when we delete it.

Last updated October 8, 2026

This is our written policy for face and voice data, including our retention schedule and how we destroy the data. It is part of our Privacy Policy and is published by Viewmax LLC, doing business as Everygen.

1. What we collect

When you use a feature that copies a real person's voice or face, our providers turn a recording or photo into a model of that voice or face (a "voiceprint" or "face geometry"). We treat the model, and the recordings and photos it comes from, as biometric data. That covers:

  • a voice you record or upload to clone with Add Voice;
  • voice recordings you add as a reference for a video generation;
  • the speaker's voice in an ad you upload or import by link to Ad Cloner, when you ask to keep the original voice;
  • photos of a face you turn into an avatar, character or AI influencer, or use with AI Clone;
  • photos of the creator in an ad you upload to Ad Cloner.

The videos and audio you make with this data are your content. They follow the media retention rules in our Privacy Policy, not this schedule.

2. Consent

When you create an account you accept our Terms of Service and our Privacy Policy, which includes this policy. In the Terms you promise that you have every right needed to upload what you upload, including every face and voice. By using a feature that copies a face or voice, you agree to Everygen and its providers collecting, storing and using that biometric data as this policy describes. The same applies when Studio or an AI assistant connected to your account uses a face or voice for you.

If the face or voice belongs to someone else, you must have their written permission and be able to show it to us if we ask. Do not upload the face or voice of anyone under 18.

3. How we use it

Only to make what you ask for, such as speaking a script in a cloned voice or putting a character in a video. We do not use biometric data to identify or verify anyone, for advertising, or to train AI models.

4. Who receives it

Only the providers that process it for us:

  • ElevenLabs, which makes and stores cloned voices, including Ad Cloner voices.
  • BytePlus (ByteDance), which receives reference images and voice recordings for Seedance video and keeps them in an asset library.
  • Kling, which runs AI Clone and stores characters you use in Kling videos.
  • The image or video model provider you pick for a generation that uses a face.
  • Cloudflare, which stores the recordings and photos for us.

The subprocessor list names each provider and where it processes data. We may also disclose biometric data when the law requires it, such as under a valid warrant or subpoena.

We do not sell, lease or trade biometric data, or otherwise profit from it.

5. Retention and destruction schedule

We delete biometric data at the earliest point in this schedule.

When we delete each kind of face and voice data
DataWhen we delete it
A cloned voice: the voice model at ElevenLabs and the voice sample we savedDeleted when you delete or replace the voice, after 12 months without use, or when your account is erased, whichever comes first. Deleting it also deletes any copy in the BytePlus asset library. The recording you uploaded to make it is kept like other uploads.
Ad Cloner clones of the speaker in your source adDeleted when you delete the project, 12 months after the project was last changed, or when your account is erased, whichever comes first.
Avatars, characters and AI influencers made from photos, and the photos we saved for themDeleted when you delete them, after 12 months without use, or when your account is erased, whichever comes first. Deleting one also deletes the copies made for it at Kling and in the BytePlus asset library. The photo you first uploaded is kept like other uploads.
Photos, video and voice recordings you add to a single generation, including AI CloneStored like other uploads and deleted 365 days after upload. Reference media sent to a Seedance model is also kept in a BytePlus asset library until your account is erased, or until you delete the saved voice, avatar or character it came from.
All of the above, when you delete your accountErased once the 30-day undo period ends, except characters registered with Kling, which stay at Kling unless you delete them first.

A job runs every day to delete face and voice data that has gone 12 months without use. Deleting a cloned voice, avatar or character also deletes the copies our providers keep of it at ElevenLabs, Kling and in the BytePlus asset library. Other copies in the BytePlus asset library are deleted when your account is erased. Copies of your files held in Cloudflare's cache can stay reachable at the same web address until the cache drops them.

Legal holds. If we must keep an account's data for a legal claim or an investigation, the schedule pauses for that account until the hold ends.

6. Withdrawing consent and asking for deletion

  • Delete a cloned voice in the app, and we delete it at ElevenLabs and delete the sample we saved of it at the same time.
  • Delete an avatar or character in the app, and we delete it, the photos we saved for it and its copies at Kling and BytePlus at the same time.
  • Delete your account from your account page to erase everything on this schedule.
  • Or email support@viewmax.io and tell us what to delete.

If someone used your face or voice on Everygen without your permission, report it on our report page or email support@viewmax.io. You do not need an account.

7. How we protect it

Recordings and photos are stored at long, unlisted web addresses. Anyone who has the exact address can open the file until it is deleted. Only the providers in section 4 receive it, and our staff look at it only to answer a support request you made, to handle a report, or when the law requires it.

8. Washington consumer health data

Washington's My Health My Data Act may treat face and voice data as consumer health data. For Washington residents:

  • What we collect: the face and voice data in section 1, which you give us.
  • Why: only to make what you ask for (section 3).
  • Who receives it: the providers in section 4, which process it for us. We share it with no one else, and we do not sell it.
  • Consent: we collect it only after the consent in section 2.
  • Your rights: you can ask whether we hold your face or voice data, get a copy, delete it, and withdraw consent. Use your account page or email support@viewmax.io. If we turn down your request, you can appeal by replying with "Appeal", and you can contact the Washington Attorney General if you disagree with the result.
